1. Acceptance of Terms
By accessing or using Dictum (“the Service”), provided by Tapnetic LLC (“Company”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
2. Description of Service
Dictum is a medical AI scribe application that provides ambient clinical documentation, transcription, and note generation for healthcare professionals. The Service is available on iOS, Android, and web platforms.
Dictum is intended to assist healthcare professionals with documentation and is not a substitute for professional medical judgment. All clinical notes should be reviewed and verified by a qualified healthcare provider before being entered into a patient's medical record.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulations
- Share your account credentials with unauthorized individuals
- Attempt to reverse engineer, decompile, or otherwise access the source code of the Service
- Use the Service in a manner that could damage, disable, or impair the Service
- Record patients without their consent or in violation of applicable privacy laws
5. Intellectual Property
The Service, including all software, algorithms, user interface designs, and documentation, is the intellectual property of Tapnetic LLC. You retain ownership of all clinical content generated using the Service. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms.
6. HIPAA Business Associate Agreement
If you are a Covered Entity or Business Associate under HIPAA, your use of the Service is subject to our Business Associate Agreement (BAA). The BAA governs our obligations regarding Protected Health Information (PHI) that may be processed through the Service. Contact us at mail@tapnetic.ai to execute a BAA.
7. Limitation of Liability
To the maximum extent permitted by law, Tapnetic LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
The Service provides AI-assisted documentation and is not a medical device. You are solely responsible for reviewing and verifying all generated content before clinical use.
8. Termination
We may suspend or terminate your access to the Service at any time for violation of these terms. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.
9. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the new terms.
